General Terms and Conditions

 

Article 1: Introduction

The website shop.attila-farks.sk is operated by an individual: Attila Farkaš (not a company), hereinafter referred to as the "author" of the works presented here, with registered domicile at Veterná 16, 93101 Šamorín, Slovak Republic.

Through this page, the author offers his art work for sale, which Internet users, individuals or legal entities, can buy via online payment or bank transfer. The author is not a VAT payer.

The author uses the services of contractors to enable the delivery of the photographs ordered by the customer through this site in the manner and time indicated on the site at the time of the order.

Every user of shop.attila-farkas.sk accepts the General Terms and Conditions. The very registration or ordering of a photograph means unconditional and irrevocable acceptance of these conditions. The author reserves the right to change these conditions at any time, so he recommends regularly checking the latest version of the conditions.

 

Article 2: Price

Prices are given in euros and do not include shipping.

Prices are not subject to tax.

Prices are subject to change at any time, mainly due to the limited number of copies of photographs sold through this site.

The shipping price varies according to the country of destination and the delivery method selected by the customer, and its amount is indicated before the order is validated.

Shipping costs are non-refundable if the order is canceled after the goods have been shipped and will be deducted from the refund.

 

Article 3: Images

Photo prints on paper:

Photo printing is carried out by a printing company of the highest quality from files whose sole copyright owner is the author.

These large format photo prints have a limited number of copies.

The photographs bear the author's signature and mark, the current copy number marking on the front or back (optional) and the hologram serial number of the Certificate of Authenticity (if applicable) on the front or back (optional).

These photographs are sold as works of art, are protected by copyright law, and their purchase does not give you the right to copy or reproduce them.

Photos are sent in a roll, in a rigid tube, with insurance and with a tracking number.

No frame or other support is supplied.

Downloadable images:

Downloadable images such as wallpapers and others are the works of the author. They contain the mark and signature of the author and are protected by copyright.

They are intended for personal use, reproduction and further distribution is illegal.

 

Article 4: Order

The photographs for sale presented on the shop.attila-farkas.sk website are provided with a description. A customer who wants to buy one of these photographs can click on the graphic display. The photograph can be added to the shopping cart by clicking on the corresponding function. If the customer wants to complete his order, he can click on the "Proceed to checkout" function located in the shopping cart. In the same place, he also has the ability to remove some or all photographs from the cart.

 

Article 5: Payment

Online payment:

For payment, the customer will be redirected to the secure server of the selected payment gateway, where he can make the payment safely. Therefore, the customer's bank data are not available to the author at any time, the protection and preservation of their integrity is therefore the responsibility of the payment gateway and the customer. As soon as the payment is confirmed on the secure server of the payment gateway, the customer has the option to return to the site shop.attila-farkas.sk or not.

To pay via PayPal, the customer must agree to the terms of use at www.paypal.com. The customer acknowledges and agrees that in the case of payment via PayPal, his account will be debited after the verification of his order.

As soon as the payment is confirmed, the system of the shop.attila-farkas.sk site will send the client a summary of the order by e-mail, including details of the ordered items, the total price, including the cost of delivery.

Pay by transfer:

The customer will make the payment by bank transfer from their bank's interface to the author's account according to the instructions that will be sent to the customer by e-mail after the order has been placed. (IBAN account number)

The author reserves the right to suspend or cancel the order or deliveries in case of refusal to approve the payment from the financial institutions, depending on the chosen payment method.

 

Article 6: Delivery

Photo prints on paper:

Before your package can be dispatched, the ordered image needs to be printed, signed and packed. This takes some time. Therefor packages are generally dispatched within 15 business days after receipt of payment.

Whichever shipment choice you make, the image is shipped rolled-up, in a solid tube, with insurance and tracking number to track your package online. A framework or other support is not provided.

Shipping fees include handling and packing fees as well as postage costs. Handling fees are fixed, whereas transport fees vary according to total weight of the shipment. We advise you to group your items in one order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them.

Tubes are amply sized and your images are well-protected.

Delivery time may vary depending on destination and other factors, between 10 and 15 business days.

Downloadable images:

Images to download will be available for download immediatelly after the payment received.

 

Article 7: Return of goods

The return of goods is possible after agreement with the author, but all transport costs are borne by the customer.

Transport risks are fully borne by the customer, therefore he must take all measures for the safety of the delivery. The shipping costs of the returned goods are fully covered by the customer, except in cases where the goods would have to be returned due to an error by the author during the preparation of the order, in which case the costs of the return are paid based on the presentation of the invoice from the post office.

No complaints can be based on misunderstanding, low evaluation of the photograph by the customer or its incompatibility with the customer's requirements. Returned photographs that were not previously agreed with the author, that are not properly packaged, will not be accepted. The customer will be able to have such photographs sent back at his own expense. In order for such photographs to be sent back, the customer must pay in advance the amounts necessary for such redirection.

In case of damage to the photograoh caused by transport, the author is not responsible, the responsibility lies with the company that ensures the transport and it is up to the customer to choose a suitable method of transport corresponding to the value of the goods, so that compensation for loss or damage can be applied.

The reconditioning fee will be deducted from any refund if the returned photograph has been accepted by the author despite minor damage.

 

Article 8: Protection of personal data

Users have the right to access and correct personal data. These data are provided to third parties only for the purpose of delivery of orderss ordered via the website, by fax, telephone or mail. They are binding for the processing of orders and their verification is possible exclusively for the purpose of combating fraud. If additional data is to be collected, the customer will be informed of their scope and reason. The customer acknowledges that the refusal to provide the required data may make it impossible to continue the delivery of the photographs ordered. He also acknowledges that as part of information verification, data may be provided to third parties solely for the purpose of verification. The customer has the opportunity to object to the possible provision of information to third parties and acknowledges that such action may lead to the impossibility of delivering the order. Article 9: Cancellation - Tolerance

In the event that one or more provisions of these terms and conditions are considered invalid or after a decision of a competent court, the remaining provisions remain in full force and effect. The fact that the author or client is not entitled to any breach of obligations under these terms, tolerating them does not mean waiving their rights. Such tolerance cannot in any case be interpreted as a waiver of the rights of the participants.
